Title: *Is a 950 a "dirt bike"? WTF!*

I have a house in a complex in Plett, and often ride my 950 to Plett and park it outside the door of the unit. The rules of the complex state "no bikes allowed" Last night this dude comes to my front door, says he's the manager, and tells me my bike isn't allowed in the complex. I assume the rule is to keep plastics and 4 wheelers out. Fair enough.

Here's a rough outline of the convo which ensued:

Manager: I'm the manager. Is that YOUR bike? Because no bikes are allowe din the complex!  (no introduction, and belittling tone)

Me: But this isn't a dirt bike, and it's my mode of transport. It's a thousand cc's!

Manager: I'm sorry, but no bikes allowed!

Me: I own this place, pay levies and have a right to arrive here on my bike. As I said, it's not a dirt bike.

Manager: Are you sure - it looks like a dirt bike.

Me: No - it's a road bike. Err...actually it’s a dual purpose bike.

Manager: What’s that?

Me: It can go anywhere – roads and dirt

Manager: So it IS a dirt bike?

Me: No. It’s a dual purpose bike.

Manager: OK – is it loud?

Me: Very

Manager: Well as long as you don’t become a nuisance!

Me: I won’t.

Manager walks off.

Firstly WTF. I felt like a kid being hauled in front of the headmaster. As usual, I was like a rabbit in the headlights and couldn’t respond properly (with indignation)

Secondly: Is a 950 a dirt bike?

that happened to me too when i had my drz 400, f@ck them, now i rev my blaster and rm extra hard when passing his house :imaposer: :imaposer:

I live in a complex & no complaints but then i try stick to the 40km speed limit.....i do try lift the front wheel over the triangular speed bumps though... ;D

Thats exactly why im NOT staying in a complex with lotsa do's and dont's...thats absurd and the peoples happiness become less than the rules.... :peepwall: :o

Screw them its a dualie so finish and klaar...you only use it on tar anyway coz it might break down on you ...its a Ktm mate... :peepwall: :pot: :imaposer: :imaposer:

Let it go ... petty officials abound and that is all they have petty power. Just like a traffic cop - sometimes better to indulge them and get away with what you want. Otherwise you are going to get the 'rules is rules' speech and get shown your signature on the document you signed agreeing to 'them rules' etc etc. He has essentially said it is alright ... now you can tell the other mother grundy residents cueing up to winge that it has been 'approved' by the manger.  :thumleft: (once a twatwaffle always a twatwaffle ... you are not going to change his spots)

But why?  The guy just did his job, albeit in typical complex supervisor style, and in the end accepted that your bike will be there.  If the neighbour's cat pees in your kitchen, you would expect the Manager to go sort it out.  It is his job.  Almost like a spietcop.  We hate them when they fine us, but love them when they fine a taxi.  This little incident is certainly not worth developing a single grey hair over.   :ricky:

J dog. Next time tell the manager Twit that it is not an off road bike becuase it has a number plate which is meant for the road!

Ill be in around Plett in August and would be willing to explain the difference to him if required!

Nuisance se moer man. Is there anything in the fine print of your documentation of ownership that even hints on bikes being forbidden on the premises?

I like these threads, one see's all the different attitudes come to fore  ;D I would let the issue simmer down, and maintain the status-quo, and remain polite  :bootyshake:  If he gives you any Kark in future, which is untoward, then gooi him with the dirties. The problem with this reasoning is that, if he is one of the owners and if he pays his levy, he is equally responsible for the making of the rule that bans bikes from the property so, telling the manager, whom he pays to fark off, he is in fact, telling himself to fark off!  

So, dude ....  cut out the middle man.  Just look in the mirror and say in a strong voice .... FARK OFF J-DOG!!!   :peepwall:

No solution- Let him feel he is the winner and give him some credit and let him feel good. On the end of the day you get out of the situation as a the overall winner without any issues and he will not give you any kak in future.
Since I have changed my attitude towards others and (trying) to be kind- things have worked out a whole lot better in my life. He has a job to do and most probably had a complaint regarding your bike- now he has the answers.
He needs some training in human relations by not even introducing himself, but again you handled it well. :thumleft:

But there is an interesting question here. I dunno the answer.

Could a duly elected body corporate of a sectional title pass a rule that bans motorcycles (of any type) in a complex ?

I checked the act :-

Sectional Titles Act, 1986 (Act No. 95 of 1986)
Part VIII Rules and Bodies Corporate
35. Rules

. . . . .

3)        Any management or conduct rule made by a developer or a body corporate shall be reasonable, and shall apply equally to all owners of units put to substantially the same purpose.

Now is it reasonable to say a quiet bike (like mine) is not allowed, but a noisy car is - that does not seem reasonable.

I think it is reasonable to argue that if a bike is allowed on a public road it may not be prevented from a complex.

I think you need to check the house rules and if there is a "no bike" rule the that is another fight.

If there is no "no bike" rule then you can gently tell him to mind his own business.

basically the house rules are there to make sure that all the folk can enjoy their ownership - "enjoy" in the legal sense.

When you leave the complex in Plett put it in your Hi Fi on repeat.... nice and loud .....and leave.. >:D

Wonderful idea.  As he owns a house in the complex,  he will return pretty soon to face the Manager backed by many other irrate owners.  That would keep him busy for some time.
