You ask him nicely to remove it. If he refuses you ask the municipality nicely, to ask him nicely, to remove it. If it does not work, its off to court.

You ask him nicely to remove it. If he refuses you ask the municipality nicely, to ask him nicely, to remove it. If it does not work, its off to court.

And this is where the building inspector who did not do his job comes in. You join him as third respondent and ask for a cost order against him.

And that is the problem I have at the moment. The usual defence is he was not called to cite to inspect. I told my builder to make notes and take foto of him when he is on cite.

I think there would be very little he could do if you removed it for him.

Not recommended. There are many solutions to this problem, depending on the nature of the encroachment, the value and worth to each etc. One extreme way is he buys your part of the property, and title deeds get amended. Its all about a balance of interest.

But you do not take matter in your own hands.

Have you taken measurements to see if the dimensions and angles and levels are correct?
Now you can make adjustments but not later.

Foundation guy: No the builder will build straight
Builder: No the plasterer will make is straight
Plasterer: No the painter will paint it straight....

And when the poor guy that has to fit the kitchen cabinets comes then you will see how skew the walls are. :eek7:
