Speeding Fine - Summons?
« on: March 10, 2014, 06:31:25 pm »
Hey Guys,

I got a little gift from the krugersdorp traffic department.

123kph in a 60 zone on the randfontein road ona sunday morning late for a meeting

In my defence I honestly thought it was a 100kph zone.

Now:

The fine says:

'No admission of guilt' and then 'report to krugersdorp magistrates court' there is no date specified or anything.

Im in Tanzania and i dont know when ill be back again. Will they issue an arrest warrant if i dont show? Anybody with some experience.

I got one on the n1 in midrand a couple of years ago where they claimed they would send a summons which never came.

Also photo for your pleasure:

I had one of those.............

R8000 fine at court, all that for a R600 playstation game!

Luck on my side though - the fine dropped due to being sent out only after the allotted time period!!!!
they have only X amount of time to issue fines before they become null & void.... :deal:

Also had an interesting experience today. I got a R500 fine somewhere between Three-sisters and the Prince Albert turn off on the N1 in Jan for not having my licence on me at the time. So I remember seeing it said if I pay before the court date it is only R250 and when I asked how to pay I was told to go to a post office and pay for it there. Now today I eventually reckon I should go pay this fine, looked everywhere for the fine, cant find it. I have no idea what the numbers were for it and even where it was given. I go to the post office anyways to see if they can trace it. I speak to the helpful gentleman, he asks "ID number, Reg number"... "aah sorry sir, there is nothing on the system" Me -  ??? :patch: So I ask is this system country wide. "Yes sir, it is." Now I don't know what to do, I know I have a court date but that's all I know. I hope a don't get a warrant for arrest from this!!!

+1

You have to sign for a summons. Either next to the road when you receive it or when it is delivered to your address.

Theres no mention of a summons though. only 'report to magistrate'

It probably reads something like "admission of guilt to avoid summons". Also a summons contains a court date on it.

What happens at a roadblock then?

Nothing happens.
Only after receiving and signing for a summons, ignoring the court date, a warrant of arrest is issued, then something might happen at a roadblock.
So study the fine to see if it is a summons or not. As a good guide: When you did not sign for it is not a summons.

I would not take chances with that.  Start with the area and see if you can get hold of the court/magistrate or whatever. They should be able to assist you.

Eish that's an expensive one! You will have to go to court, no doubt there.  You do however have a defense as the stamp in your passport is proof that you weren't here to receive the summons so that will only become an issue once you come back. I would however not wait for them.

Please elaborate. What where do you sign? What is a nasty fine vs a normal one?

True. If you go to court and pay a fine. I had one in 2006 and in my young stupidity paid it without thought. Now did a job application only to be told i have a crim recoed. After much digging finally found out it was for the 2006 incident and now have to spend close ro 2k to get it removed.

I don't sign any doc's - fines or otherwise
I never pay traffic fines
I have never been arrested at any roadblock
They must produce the warrant on the spot which they can seldom do

You obviously don't ride around the dome, northgate area, cause there they do it on a regular basis, nasty enough to ruin your day.
