I've kept this kinda quiet up until now while dealing with the matter, but everyone I've spoken to is quite astonished by this event.
 
I was riding my bike down Rivonia road and got to a construction site near the Gautrain and West Road. There was a flag lady present who had stopped the traffic whilst the crane overhead was loading steel rebars from the 15th floor to a dump truck. Being on my bike I managed to get to the front of the queue. Then she proceeded to wave the red flag so the traffic could continue.

As I rode past the dump truck i was knocked unconscious. 

Luckily I woke a few seconds later and the motorbike had not yet fallen over, and I hadnt hit a tree or any other vehicles. I had no idea what had happened as I hadnt seen any vehicles approaching me, and I knew I had left the cars behind me. I then realised that I had steel bars over my body, and a rebar had actually gone throough my protective jacket, through my work shirt, and out the other side.

So i pulled over to remove the rebars and assess what had actually happened. Then i realised the crane above that was loading these steel rebars had dropped a load on to me as i was riding underneath. My helmet took a rebar and is buggered and my right arm hurt like hell, where i saw I had been bashed by one there too. Luckily nothing pierced my skin.

The construction site staff would not assist me, and would not call the site manager. After a commotion Metro Police arrived and suddenly they could radio the site manager, who arrived 40 mins after the incident to take me to meet his directors to work out what needs to be done.

The site was closed down whilst i had to get the J88 statement completed at the SAPS as well as get the relevant medical tests wrapped up. The construction team thankfully have offered to pay for the damages to my helmet, jacket, shirt, and the basic medicals which is great.

I guess in SA we are a lot harder than in the States....where they would have been taken to court.

In my case its basically negligence I assume and I post traumatic stress, but far from the hundreds of thousands you'll see on TV and possibly not even worth pursuing. The construction team have however been very accommodating to date.

So glad I literally walked away from a freak accident.

Wtf. I have no other words. Shouldn't there be an investigation. It could have been a lot worse. You are very lucky.

Truly wtf! Glad you got away with your life!

Before you accept any refunds for damages, I'd speak to a lawyer first and get properly informed about possible options.
They could make friendly offerings on an easy way out.


Gross negligence on their side.

Man you were lucky under the circumstances.  For exactly this reason one is not allowed to be under a crane (those were the rules where I worked) and in an urban environment they should be even more cautious as the public in general will not be aware of the situation.  I am not sure who this should be reported to (probably building inspectors) and this site should be inspected and possibly shut down until they have the people, procedures and equipment in place to safely work.  Now you may have a good story to tell but this could have been beyond horrific.  Glad you are okay.

Wow, hopefully some good dash cam footage or eye witnesses ? Glad you are OK. Sounds unbelievable.

The statement i wrote down did not align with the statement from all the workers on site that was taken under oath.

So they then retrieved CCTV footage from the hotel across the road, which shows the incident and aligns with my statement. They then dealt with their staff accordingly.

I have approach 2 lawyers to date, but both havent been specialists in this area, so are quite unsure about how to proceed. I guess i need the right team to have a look, any suggestions?

Yes they ended up shutting the site down for a few days whilst the investigation proceeded. Thus the reason why they wanted me to complete the J88 and medicals quickly to avoid the longer duration of the site being shut down.

Shit! you were damn lucky! could have ended up real bad!  The rigger that gave that lift the ok should also be fired, well looking at the way that they lifted that bundle no capable rigger involved anyway!

On a lighter note... I see that piece of metal fell your GS flat, it almost resembles a Harley!

That rebar was lucky you weren't on a KTM .....

Glad you're ok Lunatic, could've been so much worse.  Everything about what happened is so wrong from the contractors side.

I am however curious to what outcome you are seeking through a team of lawyers?  Make sure that the contractor registers a third party claim and ensure you are properly examined and monitored for the next couple of weeks, even months.  If anything then comes up as a result of the incident, you have the necessary recourse.

+1......these site take out huge insurance for cases just like these and worse..........if I were you I'd look into legal route...even if it's settled "outside court" ....might as well milk it seeing as you could easily have been dead................instead you could be riding away with a new GSA. :biggrin:

How about doing it through the Road Accident fund?
You could also try the Personal Injury way. Don't say or accept anything right now I reckon tbh. If they offer to pay that can be sen as all they need to do.
I'm not a lawyer just thinking what I would do.

You have a story to tell bro, one of your nine lives has been used up. Glad you ok.

I wouldn't let this slide. A few things come to mind:
- negligence in the first place.
- an attempt to cover this up.

This is not a simple accident.

Some advice. Every bit of information from here forward, get in auditable writing. I'd think hard about what you do next. A legal fight is long, tiring and there are no guarantees. Perhaps you should be looking for a skilled negotiator and take it from there.
