Traffic fines via SMS

I received a sms stating I have a traffic fine from empd..
Question is it legal so send a notification via SMS or must it be via registered post?
Problem is I have got into the site and emailed the doc to myself as i could not make it out via cellphone,
Question.. does this then constituted the fine to be delivered?

The infringement happened early in May 800 skille nogal..

You have to physically receive the fine and sign for it. So no, just ignore those SMS's.
I see they have even found my email address somehow?

The latest thing here in East London now is to have strategic road blocks where they hold up peak hour traffic for hours.
They re-issue your fine to you at the roadblock. Then you have no option but to pay. Even have a card payment machine right there.

Legislation is in the process of being changed, if squirrel signs it off then it will be legal to send traffic fines via SMS and email

Seems very flawed to me, do they even know for sure that I still have the same number that they have on record?

They are notifying you - up to you what to do next, imo.
I normally pay, but then I amon the road daily and go through road-blocks a few timesa week, part of the job, so I see it as part of running costs, not that I get many.....
Once you have checked the post office (sic) for the fine, there may be a reduction for early payment.....?
Otherwise, los it - you can always whip out the credit card if they stop you at a roadblock.....  :biggrin:

Nothing illegal about sending a notification by sms.
Summons on the other hand has rules to comply with.

PS Quite often the sms comes from a third party firm who makes a profit on the fines they collect.  Don't know how it works exactly.
If the traffic department have given up on collecting the fines through the normal channels then you have to ask yourself...

1stly: do not pay the fine - it may prescribe.
2ndly: if you cannot duck and dive away from the roadblock,  then,  what he said.

Its just a notification

I get 2 or 3 SMS's a week, there are a few different kinds

1. They notify you that you have an outstanding fine and how view the fine and how to pay it.
2. They SMS your balance being the total amount of fines you have.. I get 2 or 3 of these as they seem to be under different accounts depending on if its my car or the companies car
3. They SMS you the status of the fine.. weather its being sent for summons or if summons has been issued or if you have a warrant of arrest issued.

Its information.. what you do with the information is up to you as stated. If you have a phone or not makes no difference to the fine or its status but they will contact you on information you have provided when taking out your licence ..

Its the ago old gripe from people.. if you get notified then everyone ducks and dives around it, when you don't get notified then people complain that they never got a notification.  :laughing4:

 :sip: The worst thing you can do is to go onto their website. Then they've got your email address, They even sebt me a bogus fine for R2000.00 and asked me to go to the website to make sure it is my reg. no. That was 10 months ago, last I heard from them.  :3some:

I also receive these sms's and I ignore them and I also avoid logging onto their website.

I received a couple of fines (either via sms or in the post) and I only received one notice for on of these fines and only then I pay the fine.

I also belief that they must work for their money. They are taking advantage of the people who gets a fright of these sms'es and immediately pay their fines. Like mentioned before they mostly have credit card facilities and if needed I will pay my fine(s) on the spot.

The lesson here is never to stick up ones hand to be screwed over ( unless of course one is that way inclined ).You have two choices - pay it or dont pay it. Its just a notice and has not been delivered to you by way of " proper service ".If you dont pay it, they have to issue you with a summons, which has to be delivered by means of " proper service ".

My guess will be that if you log onto your profile and view the fine(s) this will probably be some sort of proof for them that you did view the fine and that you are aware of it seeing that each time you log into the site and view your fines there will be a log/record of your activity on the site.
