I see guys every couple days on the Facebook groups asking about MXAlliance and if anyone knows whats happening with orders etc.


One guy posted what seems to be an email from the owner saying how the business failed and is in sequestration yadda yadda.    How does a business with no staff, overheads, premises etc "fail" ?

He is living the high life, owns a Porche GT3 and a Ducati Panigale, stays in a Golf estate, use to support him, also stuffed up my last order. Original from Heilbron, rich farmer`s son. (spoiled)

took a look at his Facebook site a week back; only to notice his (and his business partner's) table, very, very high end, all Aluminium, an aircraft wing with alu-backed visitors chairs...

hate to think what those items cost, and wonder if he used our monies towards them...

Looking forward to visiting him on my next trip.

Here then are some of the steps we followed:

•         SAPS case number – CAS348/9/2021 – Maitland Police Station, Cape Town – Tel.:  0215069400.
(we opened a case with the police FIRST)
•         Detailed affidavit signed/stamped by a police officer or Commissioner of Oath – see attached.
(then we drew up an affidavit of sequence of event, and had the stamped/signed by Commissioner of Oaths)
•         Proof of payment – see attached.
(then we provided supporting documentation of our original payment in 2020)
•         All supporting documents – MX Alliance Google Reviews – we’ve reported the site to Google and site has now been shut down.
(We reported suspicious fraudulent activity to Google)
            We have a string of e-mails requesting updates, refunds etc. available on request.
(self-explanatory - we have a paper-trail going back nearly a year, etc.)

And finally, you send all documentation to the fraud department of each bank, in this case his bank (receiver of the funds) , as well as our bank (payer of the funds).

If you want advice, please just shout - I think others SHOULD take the time to file a complaint of fraud. If the amount is meaningful, it is the right thing to do, IMHO.

This worthless human being didn’t even catch me and it’s really irking me.

The’ol Liquidation move.

I feel like we all need to raise some money, hire a firm and hold him accountable. Even if to just cost him some money!

This guy has taken so many people for a ride 

I would think the fraud charges must be laid against him in his personal capacity because otherwise he is just going to be able to duck and dive behind the name of his defunct business

I am sure he has got clever and has an attorney who will help him dodge and delay justice

Sadly the SA justice wheel turns slow and with no air in it.

From experience these guys walk away from the business, it goes into liquidation and they carry on driving their million rand cars because its not in his or the business's name.

I sent an email to the lady at Advantage and she replied with this:

'Dear Sir / Madam

Your enquiry refers and we confirm that an order was granted in the High Court of Mafikeng on the 30th of September 2021 and Mr. Vermaak has been declared insolvent. We have been advised that we will only receive the typed order in approximately 2 weeks.

 

Once the Master of the High Court, who is now seized with his estate, has appointed a Curator to attend to the winding-up of Mr. Vermaak’s estate, the details will be forwarded to you to submit your claim to the Curator.

 

We will provide you with the necessary information once same has been received from the Master."

Chris, 10 out of 10 for your attempt to recover your (now ill gotten) funds, and I still hope it will have merit, let's see.
But this chap seems to have played his cards well legally, and my guess is he can't be touched - I said legally mind you.
If he'd been living now in obscure means somewhere modest etc I'd have felt bad for him, his venture didn't work out, he got Covid and etc etc, all heartbreaking stuff.
But my guess is he does not, has not and never intended to.... and that is the avenue a lawyer must veer in to: bad intent!
Several of his excuses I'm sure can be proven to be lies, and if he's had C19 can be proven to by a simple antibody test fwiw  ;)
Declared sequestrated/insolvent or not is irrelevant, aim for 'intentional fraud' .... and him having placed the relevant orders  he must be able to prove, and my money's on that he will not be able to because he did not!
Once convicted for fraud he'll not be able to head a business anymore, I'm sure you know that (and will like that), so perhaps regroup with your legal eagle and sue the scumbag from a different angle - not moneywise per se but directly criminally, he behaved soos n roekelose sakeman!  :thumleft:

If you want to get your money back then yes, the business (not "he"!) will go scott-free!
But he does not - not at all in fact - if you challenge his past business ethics i.e his past dealings... like taking monies but not ordering the items, faking Covid (I reckon...) and not having had it, etcetera etcetera!
Basically fraudulent behaviour, and that is still very much valid hence can, and may, be challenged!

I'll break down a scenario or 2 for you in bullet point so you see how things work in SA.. well for me anyway

My registered financial advisor with years of experience advises me to get into a fractional ownership.
I invest R300k, pay his company directly and he invests in the fractional ownership.
Everything goes well for 2 years and I see some returns as promised.
Payments stop suddenly one day, I enquire and it turns out my advisor invested into a ponsi scheme skimming money off the top before paying me.. clear fraud
I take him to court.. it drags on for years all the way to the supreme court costing me well over R150k in legal fees - this was so long ago that R150k was a LOT
My financial advisor is stripped of his registration and banned from financial advising and ordered by the court to pay me R620k
Sherriff of teh court goes tohis mansion and takes everything to pay creditors
A week later the Sherriff takes everything back and puts it in place as according to his son its his..

He still drives a huge BMW, lives on the beach in a mansion.. I never saw a cent, he never saw a jail cell, and that was after years or court appearances and him crying on the stand promising to pay back the money.

That's how things work in my opinion.

Scenario 2

A friend is dating a businessman, he needed R400k to buy stock. He convinced my friend to take out a personal loan for  R400k and lend it to him.
Contracts signed, agreements on payments and liability signed.. all good
Boyfriend takes the R400k and buys designer jeans and coke.. 3 months later he stops paying the loan repayments and breaks up with my friend. We investigate and find its a pattern with all of the women he dates.
Lawyers, lawyers and more lawyers.. judge orders him to pay R500k

My friend has not seen a cent and is now left with a R400k loan @ 18% which she cant afford to pay so she has gone into a deep depression and cant fight anymore.

Boyfriend drives around in a brand new car which is in his new girlfriends name.

This is how things work in reality. Challenge or not, I have zero confidence in our judicial system to hold people accountable in any real way.
