speed fines

Sorry if this has been covered. If so, please provide link. I did search. Got a speedfine the other day. Makes me mad...as I guess most dogs out there feel when they get one of these in the post. The point is that I looked up this website: https://aarto.co.za/ssm.asp

Here it states that your fine should come to you by registered mail, if it does not it is illegal. Mine did not come to my by registered mail. It seems that having all the fines sent by registered mail is too expensive for traffic departments so they send it by regular post...however law states:

Substitution of section 30 of Act 46 of 1998
3. The following section is hereby substituted for section 30 of the principal Act: 5
“Service of documents
30. (1) Any document required to be served on an infringer in terms of
this Act, must be served on the infringer personally or sent by registered
mail to his or her last known address.

So...on this website they tell you to fill in this form; aarto 08 representation form to the relevant issuing authority and state there that the fine was sent to you by normal post instead of registered post and therefore the infringement is illegal. To get the form: https://aarto.co.za/forms.asp

It is a bit of a shlep as you need to take this form to the right police station to have it certified, you then have to post it to them by REGISTERED POST!

Even though I've got a few outstanding on this website it says that there is no outstanding fines! You make mention of that in your representation as well if the case. Play them at their own game, there are lots of information on the internet of how speedtrapping in SA is illegal, and lots of info on the real purpose of this business - it is profit driven (open to debate of course): https://www.greedfines.co.za/default.asp


I've sent my 08 form off by registered mail..will have to see what happens.
