Join a queue at a motorway off-ramp - Legal?

I think I know the laws etc about when you are allowed to filter (lane split) but what about the situation where you are on the N2 and there is a 2km long queue on the motorway hard shoulder all the way up the off-ramp and to the robots at the road where you need to turn right and under the highway. (Hope that makes sense)

This is the case at the N2/Gonubie off-ramp. The cops do occassionaly sit at the off-ramp and fine cars that try to drive along the queue and cut in at the last moment. Will I suffer the same fate?

I do expect the normal rant from cage drivers who are frustrated with me getting home quicker than them and have seen too many cages purposefully ride tight against the solid line to prevent bikes from coming past. Go figure!
